These Terms of Use ("Terms") are an agreement between you and facEmote ("facEmote", "we", "us") covering your use of the facEmote app, its iMessage extension, and this website (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
1. Who can use facEmote
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you confirm a parent or guardian has reviewed and agreed to these Terms on your behalf.
2. Your account
You are responsible for the accuracy of your account details and for keeping your credentials secure. You may delete your account at any time from the app's settings; see the Privacy Policy for what happens to your data when you do.
3. Your content
- Your photos stay yours. You retain all rights to the expression photos you capture.
- Your stickers are yours to use. You may use the stickers generated from your photos for personal, non-commercial purposes anywhere you like.
- Our license from you. You grant us a limited license to store and process your photos solely to operate the Service — generating your stickers, syncing them to the iMessage extension, and displaying them in your account. Nothing more.
- Only your face. Capture and upload only photos of yourself, or of someone who has clearly given you permission. Do not create stickers of others without their consent.
4. Purchases, subscriptions, and trials
facEmote offers the following optional purchases, billed through your Apple ID:

Prices are shown in USD; your App Store price may vary by region and is displayed before you buy.
- Auto-renewal. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
- Free trial. The yearly plan includes a 7-day free trial. If you don't cancel at least 24 hours before the trial ends, the subscription starts and you are charged. Any unused trial time is forfeited when you purchase a subscription.
- Managing & cancelling. Manage or cancel in iOS Settings → your Apple ID → Subscriptions. Deleting the app does not cancel a subscription.
- Refunds. Payments are processed by Apple, and refunds are handled by Apple under their terms — request one at reportaproblem.apple.com.
- Restoring. Use "Restore Purchases" in the app to re-activate entitlements on a new device signed into the same Apple ID.
5. Acceptable use
You agree not to:
- Upload photos of another person without their consent, or of anyone under 13.
- Use the Service to create content that is unlawful, hateful, harassing, or sexually explicit involving real people.
- Reverse-engineer, scrape, resell, or abuse the Service or its AI generation (including attempts to overwhelm generation quotas).
- Misrepresent generated stickers as another person's authentic likeness for deception or harm.
We may suspend or terminate accounts that violate these rules.
6. AI-generated content
Stickers are produced by AI image models from your captures. Generation is creative by nature: results can vary, and occasional artifacts or imperfect likenesses are part of the process, not a defect. We continually improve quality but do not guarantee any particular output.
7. Intellectual property
The Service — including the app, its design, branding, and software — is owned by facEmote and protected by applicable intellectual-property laws. These Terms don't grant you any rights to our trademarks or the Service itself beyond normal personal use.
8. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, facEmote will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
10. Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate the Service or your access to it for breach of these Terms, with notice where practicable. Sections that by their nature should survive (your content rights, disclaimers, limitation of liability) survive termination.
11. Changes to these Terms
We may update these Terms as the Service evolves. Material changes will be posted on this page with an updated effective date, and where appropriate flagged in the app. Continued use after changes means you accept them.
